Governing booking of reservations/tours for the clients
(The Tourist is hereby is requested to read all these conditions carefully as he/she shall be bound by them)

Agreement between User and Trans Orient Holidays Pvt. Ltd. :
This agreement incorporates the terms and conditions for Trans Orient Holidays Pvt. Ltd. (TOHPL) to provide services to the User of this website ("the User") and any person(s) availing services from TOHPL through this website shall be deemed to have read, understood and expressly accepted these terms and conditions, which shall govern the desired transaction or provision of such services by TOHPL for all purposes, and shall be binding on the User. All rights and liabilities of the User and/or TOHPL with respect to any services to be provided by TOHPL shall be restricted to the scope of this agreement.

TOHPL reserves the right, in its sole discretion, to terminate the access to its websites or any portion thereof at any time, without notice.


Definitions :
Independent Contractors means Hotelier/Hotel Owners/Transporters/Owners of Cruise Liners/ or any other person or organization who is being selected by the company to render services to the client.

The User means the person who uses the internet to access the website and subsequent to this, may proceed to book their stay or tour through the TOHPL website.

'Date of Booking' is the first day from which the Hotel/Resort is booked for the client.

'High Season' includes but is not restricted to the Christmas & New Year Period (20th December to 10th January)


Scope Of Services :
TOHPL are holiday facilitators only. Our role is confined to selecting and presenting to you hotels that conform to a certain standard of service, so that you can make an "informed choice" about the Hotel/Tour whose services you want to avail of. We act as a medium through which you can access information about the various hotels/resorts/palaces, their prices and the packages they offer. We only select and inspect the services provided by the independent contractors and have no control in running any of these services. We cannot be held responsible for any delayed or improper services provided by the independent agency and also for any injury, death, loss or damage which is caused by the act or default of the management or employees of any hoteliers, who are the independent entities / contacts and we have no control over them. We are also not responsible for the delay or deficiency in services provided by the hotel or any other service provider or/and any act or actions of co-travelers or co-passengers.


Registration :
The Client shall read ALL THE TERMS AND CONDITIONS ON THE WEBSITE BEFORE ACCEPTING THE SAME. The Service Voucher and Payment Receipt(if any) shall be binding on the parties and shall constitute a contract between TOHPL and the User.

|TOHPL reserves the right to decline to register any person or process for any Holiday without assigning any reason whatsoever.


Fee payment and Validity :
The User undertakes to pay the full amount specified at the time of the booking of the hotel or the tour package, failing which the User understands that the booking will not be confirmed.

In case the User, on consideration of the USD rates of hotels or tours, wishes to remit the same in Indian Rupees, a notional rate of conversion will be applied by TOHPL. In such cases, the User undertakes to express his intention to an authorized representative of TOHPL in advance.

The User shall be completely responsible for all charges, fees, duties, taxes, and assessments arising out of the use of the services, and which are beyond those included in the amounts specified by TOHPL for the use of Hotel or Tour purposes. TOHPL reserves the right to alter any and all fees from time to time, without prior notice.

In case, there is a short charging by TOHPL for the hotel or tour or any other service being provided because of any technical or other reason, it reserves the right to deduct/charge/claim the balance subsequent to the transaction at its own discretion.


Cancellation :
If circumstances compel the User to cancel the booking, the cancellation must be intimated to us in writing. Such cancellation will attract the following cancellation charges:

A. Cancellation Charges attracted for Hotel Bookings/ Hotel Packages
3 - 7 days prior to the Date of Booking	40 % of the Booking Amount
Less than 72 hours from the date of Booking or No show	100% of the Booking Amount
High Season Cancellation Charges	100% of the Booking Amount in all circumstances
B. Cancellation charges attracted for Tours/Tour Packages
More than 30 days prior to arrival	On actuals (expenses incurred inc cancellations of tickets, etc.)
16 to 30 days before arrival –	40 % of the tour cost
07 to 15 days before arrival -	50 % of the tour cost
Less than 06 days or no show -	100% of the Booking Amount in all circumstances
High Season	100% of the Booking Amount in all circumstances

Refund :
TOHPL or amendment of a Holiday due to Force Majeure or Vis Majeure. Such refund would be based on various number of factors and the decision of TOHPL on the quantum of refund shall be final. Refunds (if any) for amendment and/or cancellations will be paid directly to the User by the Company. Administrative costs of Rs. 500/- in case of hotels and tours, in addition to any other costs incurred in cancellations of tickets, etc will be deducted from the Refund Amount. It would take at least 30 days to process such refunds.


There shall be no refund if the User does not or cannot utilize the Hotels or the services provided therein. Nor can any refund be made for loss of hotel vouchers etc. by the User.


Right to Cancellation of Booking by TOHPL :
The User expressly undertakes to provide to TOHPL only correct and valid information while requesting for any services under this agreement, and not to make any misrepresentation of facts at all. Any default on part of the User would vitiate this agreement and shall disentitle the User from availing the services from TOHPL. In case TOHPL discovers or has reasons to believe at any time during or after receiving a request for services from the User that the request for services is either unauthorized or the information provided by the User or any of them is not correct or that any fact has been misrepresented by him, TOHPL in its sole discretion shall have the unrestricted right to take any steps against the User(s), including cancellation of the bookings, etc. without any prior intimation to the User. In such an event, TOHPL shall not be responsible or liable for any loss or damage that may be caused to the User or any of them as a consequence of such cancellation of booking or services. The User unequivocally indemnifies TOHPL of any such claim or liability and shall not hold TOHPL responsible for any loss or damage arising out of measures taken by TOHPL for safeguarding its own interest and that of its genuine customers.


Using the Services :
TOHPL is responsible only for the transactions that are done by the User through TOHPL. TOHPL will not be responsible for screening, censoring or otherwise controlling transactions, including whether the transaction is legal and valid as per the laws of the land of the User. The User warrants that they will abide by all such additional procedures and guidelines, as modified from time to time, in connection with the use of the services. The User further warrants that they will comply with all applicable laws and regulations regarding use of the services with respect to the jurisdiction concerned for each transaction.


Site Accuracy :
All information given in the TOHPL website is based on the information available at the time of hosting. Our site description are of amenities normally available .We reserve the right to change any information on the website before or after your booking due to any events beyond our control. In case we are aware of any changes, sufficiently in advance we will notify you at the time of booking.

TOHPL is not responsible for any errors, omissions or representations on any of its pages or on any links or on any of the linked website pages. TOHPL does not endorse any advertiser on its web pages in any manner.

If the User does not agree with any of the disclaimers above, they are advised not to read the material on any of the TOHPL pages or otherwise use any of the contents, pages, information or any other material contained on the TOHPL Websites. The User expressly agrees that use of the services is at their sole risk. The services are provided on an "as is" and "as available" basis. TOHPL may change the features or functionality of the services at any time, in their sole discretion. TOHPL expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement.

The information, software, products, and services included in or available through the TOHPL websites may include inaccuracies or typographical errors. Changes are/may be periodically made/added to the information herein. TOHPL may make improvements and/or changes in the TOHPL websites at any time without any notice to the User. Any advice received except through an authorized representative of TOHPL via the TOHPL websites should not be relied upon for any decisions.

TOHPL at its sole discretion reserves the right not to accept any customer order without assigning any reason thereof. Any contract to provide any service by TOHPL is not complete until full money towards the service is received from the customer and accepted by TOHPL.


Propriety Rights :
The User acknowledges and agrees that he/she shall not upload, post, reproduce, or distribute any content on the website that is protected by copyright, without obtaining the permission of the owner of such right. Any copyrighted or other proprietary content distributed with the consent of the owner must contain the appropriate copyright or other proprietary rights notice. The unauthorized submission or distribution of copyrighted or other proprietary content is illegal and could subject the User to personal liability or criminal prosecution.

Unless otherwise specified, the TOHPL websites are for the User's personal and non - commercial use. The User may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from the TOHPL website(s) without the express written approval from TOHPL.


Relationship :
None of the provisions of any agreement, terms and conditions, notices, or the right to use this website by the User contained herein or any other section or pages of TOHPL Websites or its partner websites, shall be deemed to constitute a partnership between the User and TOHPL and no party shall have any authority to bind or shall be deemed to be the agent of the other in any way.


Severability :
If any provision of this agreement is determined to be invalid or unenforceable in whole or in part, such invalidity or unenforceability shall attach only to such provision or part of such provision and the remaining part of such provision and all other provisions of this Agreement shall continue to be in full force and effect.


Arbitration :
For all claims or disputes of whatsoever nature relating to the User, claim of deficiency in service or the like, the same shall be resolved by a Sole Arbitrator to be nominated by TOHPL. The arbitration shall be in held in Goa. The arbitration shall be governed by the provisions of the Indian Arbitration & Conciliation Act 1996.
